POLICY TERMS

 

This Privacy Policy shall apply to the provision of all products and/or services (collectively, “Services”) under 17C Pte Ltd. This Privacy Policy shall continue to apply after your contract with us has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

1. COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA


 This supplementary section outlines the use of 17C Pte Ltd’s Membership programme and applies to all participants (referred to hereunder as “Member”, “you”, “your”, “his” or “her”) who use or access the Member Account under 17C Pte Ltd (referred to hereunder as “we”, “us” or “our). It is a mandatory condition that all members who register for the programme, agree and consent to the terms of 17C Pte Ltd’s Personal Data Protection and Privacy Policy mentioned below.
 
 In the course of using our Services, we collect the information that you provide to us directly that includes but is not limited to:

  1. your name; 
  2. your address and location information;
  3. your telephone number;
  4. your email address;
  5. your account information and preferences used in the course of using our Services;
  6. any content you upload in the course of using our Services;
  7. your location information;
  8. your log and usage data, such as your internet protocol (IP) address, search terms, device information and pages visited;
  9. information collected from cookies and similar technologies;
  10. your action and transaction history in the course of using our Services, including information about the products and/or services purchased in the transactions; 
  11. information from linked services such as third-party apps and websites; and
  12. any other information provided to us in the course using our Services.


 We may use the personal data collected for any or all of the following purposes:

  1. registration and activation of membership account; 
  2. administration of benefits and privileges under the membership programme; 
  3. management and maintenance of account; 
  4. discharging our obligations in the course of providing, maintaining and improving our Services to you;
  5. verifying your identity;
  6. provision of notifications in connection with the membership programme, redemption of awards and accumulation of points; 
  7. providing customer service, including but not limited to responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;
  8. processing payment, credit, or any other transactions;
  9. sending you notices, updates, alerts, invoices, and other support and administrative messages;
  10. sending you marketing information about products, services, offers, promotions, events, news, initiatives, lucky draws, membership and reward schemes, and any other information we think will be of interest to you;
  11. promote safety, integrity and security in the delivery of our Services;
  12. monitor and analyze trends, usage, and activities in connection with our Services;
  13. personalize our Services and provide advertisements, content and features that match user profiles and/or interests;
  14. complying with any and all applicable laws, regulations, codes of practice, guidelines, and rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;
  15. any other purposes for which you have provided the information;
  16. transmitting to any unaffiliated third parties including our third-party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for the aforementioned purposes; and
  17. any other incidental business purposes related to or in connection with the above.

 

We may disclose your personal data:

  1. where such disclosure is required for performing obligations in the course of or in connection with the provision of our Services;
  2. by consent;
  3. if we are required to do so by law, or you violate our Terms and Conditions or to protect the rights, property and safety of ourselves and others;
  4. with our affiliated companies;
  5. in the event we believe such disclosure is necessary to prevent imminent harm;
  6. where you use features of the Services that share your information such as sharing via social media platforms; or
  7. to third-party service providers, vendors, consultants, agents and other organisations necessary for the provision of the Services, in accordance with Clause 3 below.
     
     

2. CONSENT

 

By submitting your personal data to us, you consent to us collecting, using, disclosing and processing your personal data in accordance with this Privacy Policy.

Where you submit personal data relating to other individuals, including but not limited to family members or other third parties including minors (“Related Individuals”), you represent and warrant that you have obtained the consent of such Related Individuals to the collection, use, disclosure and processing of their personal data in accordance with this Privacy Policy.

The consent provided for the collection, use and disclosure of your personal data and the personal date of Related Individuals shall remain valid until such time it is withdrawn by you or such Related Individuals. You or the Member in general, may at any time and for any reason, choose to withdraw his/her consent to the collection, processing and use of his/her personal data by giving 17C Pte Ltd prior notice in writing and necessary verification. Requests for such withdrawals are to be sent via e-mail to marketing@17tea.co. We will respond to any such request within ten (10) business days of receipt and in the event such withdrawal renders us unable to continue to provide our Services to you, require a further confirmation before processing such request. Upon successful withdrawal of consent, the Member Account, unused redeemable points, rewards, benefits, privileges and any other form of entitlement under the membership programme shall be revoked immediately and 17C Pte Ltd shall be discharged from any further obligations to the Member.

Please note that such withdrawal of consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws.
 
 3. THIRD-PARTY SERVICES AND LINKS 

 
 We engage third-party providers with a view to only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. These are subject to such third-party providers’ own privacy policies in respect to the information we are required to provide to them in the provision of our Services.

We recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. We are not responsible for the content and privacy practices of websites that you have been directed to from links accessed in the course of our Services and we encourage you to consult the privacy notices of those sites.

4. Member Content

 Any content such as profile information, comments, questions, media files, and other content or information created by the Member (“Member Content”) remains yours and the management claim no ownership rights over Member Content created by you.
 
 You agree not to upload Member Content that:

  1. may create a risk of harm, loss, physical or mental injury, emotional distress, or any other form of harm;
  2. may create a risk of any other loss or damage to any person or property;
  3. we deem to be inappropriate;
  4. request personal data;
  5. contravenes any laws or regulations in Singapore;
  6. contains any confidential information; and
  7. interferes with other Members of the Service.

You agree that any Member Content that you upload will not violate third-party rights of any kind. The management reserves the right, but is not obligated, to reject and/or remove any Member Content that we believe, in our sole discretion, violates these provisions.
 
 In connection with your Member Content, you affirm, represent and warrant the following:

A. You have the consent of each and every identifiable natural person in the Member Content to use such persons name or likeness in the manner contemplated by the Service and this Agreement, and each such person has released you from any liability that may arise in relation to such use.
 
 B. Your Member Content and our use thereof as contemplated by this Agreement and the Service will not violate any law or regulation or infringe any rights of any third party. The management takes no responsibility and assume no liability for any Member Content that you or any other Member or third-party posts or sends over the Services. You shall be solely responsible for your Member Content and any consequences arising out of your use of Member Content.
 
 You agree to grant the management a non-exclusive, limited, and non-transferable license to use the Member Content in connection with the Services insofar as you continue to maintain a Member Account.

5. Our Proprietary Rights
 

 As with the Member Content, the Services and all materials and information therein or transferred thereby, including, without limitation, information about your phone or device, or data that is otherwise generated, collected or transmitted through use of the Services or the App, software, images, text, graphics, illustrations, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and Member Content belonging to other Members and all Intellectual Property Rights related thereto, are the exclusive property of 17C Pte Ltd and our licensors (the “Company Content”). Nothing in this Agreement shall be deemed to grant you a license to, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from any Company Content. Use of the Company Content for any purpose not expressly permitted by this Agreement is strictly prohibited.


 
 6. SECURITY
 

While security cannot be guaranteed, we will endeavour to safeguard your personal data from loss, theft, misuse, or unauthorised access, collection, use, disclosure, alteration, copying, modification, disposal or similar risks, we have introduced the appropriate administrative, physical and technical measures which include antivirus protection, encryption and the use of privacy filters to secure all storage and transmission of personal data by us, and disclosing personal data both internally and to our authorised third party service providers and agents only on a need-to-know basis. We will periodically review and enhance our information security measures. However, while security measures may be in place, by signing up as a Member, you acknowledge and agree that you provide your personal information at your own risk.
 

7. RETENTION OF PERSONAL DATA


 We may retain your personal data for as long as it is necessary to fulfil the purpose for which it was collected, and/or as required or permitted by applicable laws.

8. CHANGES TO THIS PRIVACY POLICY


 We reserve the right to modify this privacy policy in our sole and absolute discretion from time to time, such changes to take effect immediately. We will notify you of such changes via e-mail, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. If our store is acquired or merged with another company, you consent that your personal data may be transferred accordingly.
